These general terms describe the rules applicable when you use VitalMetrics' website, mobile application, and other services.
By creating a user account, making a purchase, subscribing, or otherwise using VitalMetrics' services, you accept these terms.
Chapter 1
1. About these Terms
1.1 The Parties
These general terms ("the Terms") apply between you who use, purchase, or otherwise access VitalMetrics’ services ("you", "your", "the user" or "the customer") and VitalMetrics BioAnalytics AB, registration number 559544-9348 ("VitalMetrics", "we", "us" or "our").
When we use any of these designations, the same respective party is referred to, unless the context clearly indicates otherwise.
1.2 Scope of the Terms
The Terms govern your use of VitalMetrics' website, mobile application, user account, and digital platform as well as the purchase and use of our products and services, regardless of the interface through which they are provided.
Special terms or product descriptions may apply to a specific product, feature, campaign, or service. If such special terms deviate from these Terms, the special terms shall take precedence for the respective product, feature, or service.
1.3 When the Terms are Accepted
You accept the Terms when you, for example:
- create a user account,
- place an order,
- subscribe,
- activate or use a test kit,
- use any other service covered by the Terms.
Before a binding purchase or subscription is made, you will have the opportunity to review the terms and information applicable to the purchase.
If you do not accept the Terms, you are not permitted to create an account, make purchases, or use parts of the service that require acceptance of the Terms.
1.4 Other Applicable Documents
The Terms shall be read together with other legal documents applicable to your use of the service, such as the Privacy Policy and the Cookie Policy as well as any specific terms that apply to a particular product, service, feature, or campaign.
The Privacy Policy describes how VitalMetrics collects, uses, stores, and otherwise processes personal data.
The Cookie Policy describes how cookies and similar technologies are used on VitalMetrics' website and, where applicable, in parts of the service.
In the event of conflict between these Terms and special terms explicitly applying to a specific product or service, the special terms shall take precedence for that product or service.
1.5 Mandatory Consumer Law
If you use VitalMetrics primarily for purposes outside of commercial business, you act as a consumer.
Nothing in these Terms limits the rights you have under mandatory consumer legislation.
If any provision in the Terms conflicts with mandatory law, that provision shall not apply to the extent it conflicts with the law. The remaining parts of the Terms shall continue to apply.
1.6 Purpose of the Service
VitalMetrics provides a digital platform for wellness, performance, and lifestyle insights.
Through the service, you can among other things collect, organize, compile, and present information about biomarkers, nutrition, training, sleep, body measurements, supplements, and other lifestyle-related factors.
The service may also include visualizations, history, trends, technical calculations, descriptive analyses, and AI-based features.
To provide the service, we cooperate with external parties, such as laboratories, medical referrers, payment providers, identification services, logistics partners, and technical suppliers.
VitalMetrics does not provide healthcare and does not act as a treating healthcare provider. The precise nature, scope, and limitations of the service are described further in the Terms.
Chapter 2
2. Account and User
2.1 Authority and Age Requirement
To use VitalMetrics services, you must:
- be at least 18 years old,
- have the legal capacity to enter into binding agreements under applicable law,
- be resident in a country where VitalMetrics currently offers the service,
- have access to the electronic identification required to use the service in the relevant country,
- use the service for personal purposes, and
- comply with these Terms and other instructions applicable to the service.
Which countries and which forms of electronic identification are supported are specified during registration or on VitalMetrics’ website.
Your user account and subscription are personal and may not be used for commercial purposes, resale, or other professional activities without VitalMetrics’ written consent.
If the service includes biomarker tests or test kits, these may only be used by the person whose user account and order they pertain to.
2.2 Account Registration
To gain access to all or parts of VitalMetrics services, you need to create a personal user account.
When registering an account, you must provide the requested information and follow the instructions applicable to the registration process.
A user account is personal and may not be sold, transferred, lent, or otherwise made available to anyone else.
2.3 Accurate User Information
You are responsible for ensuring that the information provided to VitalMetrics is accurate, complete, and current.
If any of your information changes, you are responsible for updating the information without undue delay.
Incorrect, outdated, or incomplete information may affect delivery of test kits, identification, laboratory handling, support, and other parts of the service.
2.4 BankID and Identification
We may use BankID or another equivalent electronic identification when necessary to verify your identity or protect the service.
Examples of situations where identification may be required include:
- account registration,
- login,
- ordering certain services,
- access to sensitive information, or
- handling particularly privacy-sensitive support cases.
Identification is performed using the electronic identification supported by the service, for example BankID, and is managed through external providers of identification services.
Personal identity numbers are processed when necessary to identify you, administer laboratory services, create referrals, fulfill legal obligations, and provide the service. How personal data is processed is described in more detail in VitalMetrics’ Privacy Policy.
2.5 Account Security
Your electronic identification is a central part of the security of your user account. You are responsible for protecting your BankID or other e-identification and must not allow anyone else to use it to access your account.
You are responsible for the use of your account and electronic identification unless otherwise provided by applicable law or if unauthorized use is due to deficiencies in VitalMetrics’ security or other circumstances beyond your reasonable control.
If you suspect that someone unauthorized has accessed your account or your BankID or other electronic identification has been compromised, you must immediately contact VitalMetrics support. You must also block the relevant e-identification and obtain a new one according to instructions from your bank or the provider that issued the e-identification.
2.6 Restriction and Suspension of Account
VitalMetrics may temporarily restrict or suspend a user account if there are valid grounds, such as:
- suspected unauthorized use,
- security incidents,
- fraud or abuse,
- breach of these Terms, or
- when required by law or authority decision.
If possible, we will inform you of the measure and give you the opportunity to express yourself or rectify any deficiencies before an account is permanently terminated.
Chapter 3
3. Orders and subscriptions
3.1 Order
When you place an order through our website or mobile application, you make an offer to enter into an agreement with us.
Your order includes the products, services, or subscriptions specified at the time of purchase.
You are responsible for verifying that all information in the order is correct before completing the purchase.
3.2 Conclusion of agreement
A binding agreement is entered into when VitalMetrics has confirmed your order and the payment has been approved or otherwise accepted according to the payment method used.
VitalMetrics may refuse or cancel an order if there are objective grounds, such as technical or administrative errors, obviously incorrect prices, suspected fraud, incorrect payment details, or other circumstances that reasonably prevent the order from being fulfilled.
If an order cannot be fulfilled, VitalMetrics will, when possible, inform you and refund any payment made without undue delay.
3.3 Subscription
VitalMetrics offers subscriptions that may include recurring biomarker tests, access to digital features, historical results, analyses, and other services depending on the subscription you have chosen.
Subscriptions are personal and may only be used by the registered user.
Which features, tests, and services are included is always specified at the time of order.
3.4 Subscription period and renewal
Subscriptions take effect from the time specified at the time of purchase.
If the subscription is subject to a binding period, this applies during the agreed period. When the binding period expires, the subscription continues indefinitely with the same payment interval unless terminated or otherwise expressly stated at the time of purchase.
Some subscriptions may include price benefits or other loyalty benefits. The conditions for such benefits, including how they may be retained or terminated, are specified at the time of purchase and form part of the subscription terms.
You may terminate your subscription at any time. If the subscription is subject to a binding period, the termination takes effect when the binding period expires, unless otherwise follows from mandatory law or is expressly stated.
Payment is made in advance according to the selected payment method.
3.5 Price and price changes
Current prices, payment intervals, and any fees are always specified before the purchase is completed.
Unless otherwise expressly stated, the price you accepted at the time of purchase applies during the agreed binding period.
For subscriptions subject to a price benefit or other loyalty benefits, special conditions may apply regarding how the price is retained after the binding period ends. Such conditions are specified at the time of purchase.
Information about price benefits, loyalty benefits, and other offers presented at the time of purchase form part of the agreement between you and VitalMetrics.
VitalMetrics may change prices for new subscriptions and future subscription periods. For existing subscriptions, special conditions may apply for price benefits or other loyalty benefits. If a price change affects your subscription, you will be informed in reasonable time before the change takes effect.
3.6 Termination
You may terminate your subscription at any time via your user account or otherwise according to the instructions we provide.
If the subscription is subject to a binding period, the termination takes effect when the binding period expires. If the subscription lacks a binding period, it ends at the end of the already paid subscription period unless otherwise stated.
If your subscription is terminated, access to the features included in the subscription will cease from the subscription’s end date. Some information, such as previous test results and history, may still be available in accordance with these Terms and our Privacy Policy.
3.7 Availability and changes to the service
We continuously develop our products and services.
This means that features, user interfaces, content, biomarker panels, integrations, technical solutions, and other parts of the service may change, improve, be replaced, or be discontinued over time.
We strive to ensure that such changes do not constitute a material deterioration of the service you have agreed upon.
If a change is of material significance to your subscription or your rights, we will inform you in advance when possible.
Chapter 4
4. Payment, test kits, and laboratory analysis
4.1 Payment
Payment for our products, services, and subscriptions is made using the payment methods offered at the time of purchase.
Current prices, fees, and payment terms are always specified before the purchase is completed.
If a payment cannot be completed, VitalMetrics has the right to refuse or cancel the order until valid payment has been received.
For recurring subscriptions, you are responsible for ensuring that the selected payment method is valid and can be charged according to the subscription plan chosen.
4.2 Payment providers
Payments are managed by external payment providers, such as Stripe.
We do not normally process complete card details or other sensitive payment information but only have access to the information necessary to administer orders, subscriptions, and payment status.
The external payment provider is responsible for the technical handling of the payment and for processing payment information in accordance with applicable security standards and its own privacy policy.
4.3 Test kit
If your order includes biomarker tests, we or one of our partners will send a personal test kit to the delivery address you have provided.
The test kit is intended for the registered user and may not be used by any other person.
The user is responsible for verifying that the delivery details are correct before completing the order.
4.4 Sampling
You are responsible for following the instructions provided with the test kit, performing the sampling according to the instructions, sending in the sample within the specified time period, and handling the sample in a way that does not affect the quality of the analysis.
Incorrect sampling, inadequate handling, or late submission may result in the laboratory being unable to analyze the sample or affect the result.
4.5 Laboratory analysis
Laboratory analyses are performed by external laboratories.
For certain analyses, a referral from a licensed physician or other authorized healthcare professional is required according to applicable legislation. In such cases, VitalMetrics cooperates with external medical referrers.
VitalMetrics is responsible for the digital platform and administration surrounding the service but is not responsible for the medical assessment, the laboratory's analytical methods, or the medical quality assurance performed by the laboratory or the referrer.
4.6 Delivery
Delivery of test kits and other physical products is carried out through external logistics and distribution partners.
Delivery times stated on the website or at the time of order are estimated unless otherwise expressly stated.
Laboratory analyses and medical assessments are performed independently by the respective laboratory and medical referrer.
VitalMetrics is not responsible for delays caused by carriers, customs processing, government decisions, or other circumstances beyond VitalMetrics’ reasonable control.
If you have not received your test kit within a reasonable time, you should contact our support as soon as possible.
4.7 Delivery delays
Recurring biomarker tests are designed to be conducted at regular intervals to allow relevant comparisons and trend analyses over time. Minor deviations in test timings may occur and normally do not affect the function or purpose of the service.
If a substantial delivery delay for which VitalMetrics is responsible causes a planned test to need to be postponed, we may, after an individual assessment, offer a reasonable solution, for example by:
- replacement delivery,
- adjusted test interval,
- extension of the subscription, or
- other appropriate compensation.
The solution offered depends on the circumstances of the individual case, the cause of the delay, the extent of the delay, and how it affects your ability to use the service as intended.
Delivery times as well as the timing of sampling, laboratory analysis, and reporting of results may also be affected by external laboratories' processing times, medical referrers' administrative processes, or other circumstances beyond VitalMetrics' direct control.
Chapter 5
5. Results and health data
5.1 Presentation of results
We present information obtained from laboratory analyses, your own recordings, and other data sources connected to the service.
Results can, for example, be presented as individual measurement values, history, graphs, visualizations, trend analyses, summaries, and other descriptive presentations of available information.
The manner in which the information is presented may change as the service evolves.
5.2 Data sources
The information in the service may be based on data from external laboratories, your own entries, connected devices and sensors, external integrations you have approved, as well as our own technical calculations and system logic.
Which data sources are used depends on which features, integrations, and services you have chosen to use.
The quality and completeness of the results are affected by the quality of the data available.
5.3 History and trend analysis
VitalMetrics may compile historical measurement values and other information to show developments and changes over time.
Trend analyses and historical summaries are based on the data recorded at each time point and can change if new information is added or previous data corrected.
5.4 Limitations
We cannot guarantee that all information is always complete or updated, that all changes or deviations are identified, that all analyses are relevant for each individual user or situation, or that external data sources are always available or error-free.
Results and summaries must always be interpreted based on the information available at the relevant time.
5.5 No medical advice
VitalMetrics is a digital platform designed to help you understand and track your health data over time with a focus on training, performance, well-being, and lifestyle-related factors. The service is not intended for medical diagnosis or as a replacement for medical health examinations, care, or treatment.
Results, visualizations, summaries, and analyses do not constitute medical advice, medical assessment, diagnosis, or treatment and should not be used as the sole basis for medical decisions.
If you have questions about health, illness, or medical treatment, you should always contact licensed healthcare professionals.
If laboratory results or other information in the service indicate that you may need medical advice, you should contact licensed healthcare professionals.
Chapter 6
6. AI features
6.1 AI as part of the service
We use artificial intelligence (AI) as an integrated part of the service to improve the user experience, analyze information, and make complex health data more accessible and understandable.
AI can be used to analyze, structure, compile, and present information in a more clear and comprehensible manner.
The AI features are based on the information available in the service at the relevant time as well as the models and data sources used for each respective feature.
6.2 How AI is used
AI can be used, among other things, to summarize information, describe history and development over time, identify patterns and correlations, present visualizations and explanations, and provide general information about biomarkers, lifestyle factors, and other health-related areas. AI can also help you better understand the information available in the service.
Which AI features are available may change and develop over time. AI can also be used in other functions developed and introduced in the service over time.
6.3 Limitations
AI-generated information may contain inaccuracies, be based on incomplete information, contain simplifications or generalizations, and change as models, data sources, and technology develop.
You are solely responsible for how AI-generated information is used and interpreted.
6.4 No automated medical assessment
AI is not used as a replacement for medical assessment or to make independent medical decisions about you.
AI does not constitute medical advice, medical assessment, diagnosis, or treatment and should not be used as the sole basis for medical decisions.
6.5 Ongoing development of AI
VitalMetrics continuously develops its AI features.
This means that AI models, features, analyses, presentations, and user experiences may change, improve, be replaced, or removed over time.
Such changes constitute a natural part of the service's development and do not in themselves constitute a breach of these Terms.
6.6 Responsible use of AI
We develop and use AI with the aim that the features should be relevant, transparent, and reliable. AI is intended to support your understanding of your information but does not replace personal judgment or professional advice when such is needed.
Chapter 7
7. User responsibilities
7.1 Correct information
You are responsible for ensuring that the information you provide to us is correct, complete, and current.
This applies, for example, to contact information, delivery details, and other information needed for us to provide the service.
Incorrect or incomplete information may affect the ability to deliver test kits, conduct laboratory analyses, or provide other parts of the service.
7.2 Personal use
The service is intended for personal use.
You may not:
- allow someone else to use your account,
- use someone else's account,
- transfer or sell your subscription,
- use test kits or other personal services for anyone other than yourself, unless otherwise expressly stated in the service or required by applicable law.
7.3 Proper use of the service
You are responsible for using the service in accordance with these Terms and the instructions and guidelines we provide.
If the service includes sampling, you are also responsible for following the instructions related to sampling, handling, and return of the sample.
7.4 Prohibited use
You may not use the service in a way that violates law or government decisions, attempts to circumvent the service's security functions, risks damaging, disturbing, or overloading the service, provides unauthorized access to systems, data, or user accounts, or is used to copy, automatically collect, or otherwise exploit the service's content in violation of these Terms.
You may also not use the service to develop or improve competing products or services without our written approval.
7.5 Reporting problems
If you discover security breaches, inaccuracies, or other suspected misuse of the service, you must inform us without undue delay.
This helps us protect both the service and other users.
If you deliberately violate these Terms, we may limit or terminate your account in accordance with chapter 2.6.
Chapter 8
8. Intellectual property rights
8.1 Ownership
All intellectual property rights included in or provided through the service belong to VitalMetrics BioAnalytics AB or our licensors, unless otherwise expressly stated.
This includes, among other things:
- software and source code,
- algorithms and system logic,
- AI models, AI features, and AI-generated content,
- databases and data structures,
- visualizations, diagrams, and graphs,
- design, user interface, and user experience,
- texts, images, illustrations, and other content,
- trademarks, logos, and distinguishing marks,
- documentation, methodology and other technical solutions.
Your use of the service does not transfer any ownership rights in the service or its content to you.
8.2 Limited right of use
For the duration of your right to use the service, VitalMetrics grants you a limited, personal, non-exclusive, non-transferable and revocable right to use the service for personal use in accordance with these Terms.
This right does not include any right to copy, sell, license or otherwise commercially exploit the service or its content.
8.3 Prohibited use
Unless otherwise required by mandatory law or expressly approved in writing by VitalMetrics, you may not:
- copy, reproduce, or distribute content from the service,
- modify, decompile or attempt to recreate the service’s technical solutions,
- automatically collect, extract or scrape information from the service,
- use the service or its content to develop, train or improve competing products, AI models or other automated systems or commercial services,
- remove or alter copyright or trademark notices.
8.4 User content
You retain ownership of the data and content that you yourself register or upload to the service. AI-generated compilations, visualizations and analyses based on this data are part of the service’s functionalities and do not change ownership of your underlying data.
By using the service, you grant us the rights required to store, process, analyze, present and otherwise use the content to the extent necessary to provide the service and fulfill the agreement with you.
Processing of personal data is regulated in VitalMetrics Privacy Policy.
8.5 Feedback and improvement suggestions
If you voluntarily provide feedback, ideas, improvement suggestions or other input regarding VitalMetrics services, we may use such feedback without obligation to pay compensation or obtain further consent from you.
This does not affect your rights under applicable law or VitalMetrics’ obligations to process personal data in accordance with the Privacy Policy.
Chapter 9
9. Limitation of liability
9.1 Service availability
We strive to keep the service available with high operational reliability and quality.
Nevertheless, the service may from time to time be affected by scheduled maintenance, technical faults, security measures or other circumstances causing all or parts of the service to be temporarily unavailable.
We cannot guarantee that the service will always be free from interruptions, errors or limitations.
9.2 Information and results
Information, results, visualizations, compilations, trend analyses and other content presented in the service are based on the information available at the respective time.
VitalMetrics is not responsible for decisions or actions taken by you or anyone else based on information from the service.
Results, analyses and AI-generated content do not constitute medical advice, medical assessment, diagnosis or treatment and should not be used as the sole basis for medical decisions.
9.3 External partners
We collaborate with external providers for, among other things, laboratory analyses, medical referrals, payment processing, identification, logistics, communication and technical infrastructure.
We are not responsible for errors, delays or deficiencies solely caused by such external parties or other circumstances beyond our reasonable control.
For example, handling times at laboratories, medical referrers or authorities may affect when certain parts of the service can be performed or when results become available.
This does not affect our responsibility for the parts of the service for which we are responsible under law or agreement.
9.4 Limitation of liability
To the extent permitted by applicable law, VitalMetrics is not liable for indirect damages, consequential damages, lost profits, lost savings, data loss or other indirect financial damage arising from use of the service.
VitalMetrics’ total liability to you, regardless of the legal basis, is limited to the amount you have actually paid to VitalMetrics for the relevant service during the twelve (12) months immediately preceding the event giving rise to the claim.
9.5 Mandatory law
Nothing in these Terms shall be interpreted as limiting or excluding VitalMetrics’ liability which according to mandatory law may not be limited or excluded.
This includes, among other things, liability in cases of intent or gross negligence as well as the rights consumers have under mandatory consumer legislation.
Chapter 10
10. Right of withdrawal and refund
10.1 Consumer right of withdrawal
If you are a consumer, you in certain cases have the right to withdraw your purchase pursuant to applicable consumer legislation, including the Act (2005:59) on Distance Contracts and Off-Premises Contracts.
Unless otherwise stipulated by law, the withdrawal period is fourteen (14) days.
The withdrawal period is calculated:
- for physical products from the day you or a person you have designated receives the product,
- for digital services and subscriptions from the day the agreement is entered into.
VitalMetrics provides an integrated service which may include digital services, subscriptions, referral management, test kits and laboratory analysis. How the right of withdrawal is affected when parts of the service start immediately after purchase is explained below.
10.2 Services started immediately
Once a purchase is made, VitalMetrics may immediately begin providing the whole or part of the service. This may include, among other things, that:
- your subscription is activated,
- the digital service becomes available,
- a referral is created and sent to the relevant partner,
- a test kit is ordered for dispatch, and
- other administrative measures necessary to provide the service are started.
When the service is started at your request, the right of withdrawal may fully or partially cease to the extent permitted by applicable law. If explicit consent is required by law, this will be obtained in connection with the purchase.
10.3 Test kits and laboratory analysis
VitalMetrics test kits are personal and intended for use by the registered user.
If a test kit has been opened, used or otherwise handled in a manner that means it can no longer be returned in unchanged condition, the right of withdrawal may be limited or cease to the extent permitted by applicable law.
When a referral has been created, a test kit ordered or laboratory analysis commenced, this may also affect the ability to withdraw from the purchase or obtain a refund, to the extent permitted by applicable law.
VitalMetrics has the right to make reasonable deductions for depreciation or costs incurred due to the user’s handling of the test kit or other parts of the service already performed, if allowed by law.
10.4 Digital services and subscriptions
For digital services and subscriptions, the right of withdrawal may cease when provision has commenced, provided this is in accordance with applicable law and you, when required, have given express consent to the service starting during the withdrawal period and confirmed that you may thereby lose your right of withdrawal.
If the right of withdrawal has ceased as described above, no refund will be made for the part of the service already provided, to the extent permitted by applicable law.
10.5 Refund
If you are entitled to a refund, we will refund the amount to which you are entitled without undue delay and no later than the time required by applicable law.
Refunds are normally made using the same payment method used for the purchase, unless otherwise agreed.
Where permitted by law, VitalMetrics may withhold refund until a product has been returned or otherwise shown that the conditions for refund have been met.
10.6 Mandatory consumer legislation
Nothing in this chapter limits the rights you have under mandatory consumer legislation.
If a provision in this chapter conflicts with mandatory law, that provision shall not apply to the extent it conflicts with the law.
Chapter 11
11. Changes to the terms
11.1 Right to amend the terms
VitalMetrics may from time to time update or amend these Terms when there are valid reasons.
Such reasons may include, for example:
- changes in legislation or regulatory requirements,
- development or changes to the service,
- introduction of new products, features or subscriptions,
- security improvements or technical changes, or
- other changes necessary for us to provide the service in an appropriate manner.
11.2 Information about changes
If a change is material to you, we will inform you in a reasonable time before the change takes effect.
Information may be provided via, for example:
- the website,
- the mobile application,
- email, or
- other appropriate communication channel.
Minor editorial or administrative changes may be made without a special prior notice.
11.3 When changes take effect
Unless otherwise stated, the updated Terms shall take effect from the date stated at publication.
If you have an ongoing subscription, the updated Terms apply from the next subscription period, unless mandatory law or the specific change requires otherwise.
11.4 If you do not accept the changes
If you do not accept a material change to the Terms, you have the right to terminate your user account and, if applicable, cancel your subscription before the change takes effect.
If you continue to use the service after the updated Terms have taken effect, you are deemed to have accepted the new Terms, to the extent permitted by applicable law.
Chapter 12
12. Force majeure
12.1 Events beyond our control
VitalMetrics is not liable for delays, interruptions or failure to fulfill our obligations under these Terms if this is due to circumstances beyond our reasonable control and which we could not reasonably foresee or avoid.
Such circumstances may, for example, include:
- natural disasters, extreme weather conditions or pandemics,
- war, terrorism, sabotage, riots or other civil disturbances,
- government decisions, legislative changes or other public interventions,
- strike, lockout or other labor disputes,
- extensive disturbances at laboratories, logistics partners, payment providers, identification services, cloud infrastructure suppliers or other external suppliers,
- major disruptions in electricity supply, electronic communication networks or other critical infrastructure,
- cyberattacks or other security incidents that could not reasonably have been prevented.
12.2 Consequences
If a force majeure event occurs, VitalMetrics is exempt from liability for that part of its obligations which cannot be fulfilled during the time the obstacle persists.
VitalMetrics shall, to a reasonable extent, limit the consequences of the event and resume fulfillment of its obligations as soon as practically possible.
12.3 Information to the user
If a force majeure event materially affects the service, we will, when practically possible, inform you of the situation and provide relevant information about how the service is affected.
Nothing in this chapter limits your rights under mandatory law.
Chapter 13
13. Applicable law and dispute
13.1 Applicable law
These Terms shall be interpreted and applied in accordance with Swedish law.
If you are a consumer, this does not affect the rights you may have under mandatory legislation in the country where you have your habitual residence, to the extent such law is applicable.
13.2 Dispute resolution
If a dispute arises between you and us, we shall primarily attempt to resolve the dispute through dialogue and mutual agreement.
If you have questions or objections, we encourage you to first contact our support so that we have the opportunity to investigate and, if possible, resolve the matter quickly and smoothly.
13.3 Alternative dispute resolution
If you are a consumer, you have the right to have a dispute reviewed by the National Board for Consumer Disputes (ARN), to the extent the dispute falls under ARN’s jurisdiction.

Consumers residing within the European Union may also have the right to use the European Commission’s Online Dispute Resolution platform (ODR), to the extent it is available and applicable under applicable regulations.
13.4 Judicial review
If a dispute cannot be resolved through dialogue or otherwise, the dispute may be reviewed by a competent Swedish court, unless mandatory law provides otherwise.
13.5 Cessation of operations
If VitalMetrics permanently ceases its operations or enters bankruptcy, the service may wholly or partly be discontinued.
VitalMetrics will, to the extent practically possible and consistent with applicable law, inform users of the situation and take reasonable measures to enable an orderly termination of the service.
If practically possible and consistent with applicable law, users will also be given the opportunity to export or otherwise access their personal data and other information to which they are entitled before the service ceases.
Any refunds or other financial claims will be handled in accordance with applicable law and, if applicable, within the framework of bankruptcy proceedings.
